When a majority of the U.S. Supreme Court chose not to block Texas’s 6-week abortion ban from going into effect, Justice Sonia Sotomayor wrote in her blistering dissent: “Presented with an application to enjoin a flagrantly unconstitutional law engineered to prohibit women from exercising their constitutional rights and evade judicial scrutiny, a majority of Justices have opted to bury their heads in the sand.

While the Court’s majority may have their heads in the sand, NAPW has long been aware of the full import of attacks on Roe v. Wade. Roe didn’t just protect the right to abortion, it also rejected the idea of fetal personhood. The Supreme Court held that, throughout pregnancy, a woman’s life and health must be paramount. In doing this, Roe established that women, even when pregnant and during all stages of pregnancy, are full persons under the Constitution.

That is why we are part of the fight to preserve Roe and why, for twenty years, NAPW has worked to ensure that pregnancy is not the basis for depriving women and pregnant people of their status as full rights-bearing persons.

Regardless of the outcome at the Supreme Court in Dobbs v. Jackson, NAPW will continue to be there every step of the way, to fight for the rights of all pregnant people, including those who have experienced pregnancy loss, those who have given birth, and those who have taken steps to end their pregnancies, just as we have done for the past two decades.
